Obtaining Financial Recovery after a Serious Accident Caused by a Drunk Driver in Pennsylvania

Securing Full Financial Compensation for Your Injuries and Losses

Accidents do happen, but when someone gets behind the wheel of a car after drinking and causes a car crash, that's really no accident. That's willful and reckless disregard for the health and safety of others. The legal limit for DUI is now .08%. Drunk drivers cause countless people to suffer life-changing injuries, and leave hundreds of grieving families in their wake.

If your life has been turned upside down in a car crash caused by a drunk driver along the Pennsylvania Turnpike, Interstate 99, 70, 76, or 80, or any Pennsylvania roadway, contact personal injury attorney Joseph Nypaver.  I have represented drunk driving victims from Altoona, Hollidaysburg, Tyrone, Ebensburg, and other towns in Blair and surrounding counties.

I  have help injured people find financial recovery through personal injury and wrongful death lawsuits.

Limited Tort: What Does This Mean in a Drunk Driving Accident?

In order to reduce your car insurance premium, you may have chosen a "limited tort" policy. This means that for most types of accidents, unless you suffered serious injury or permanent disfigurement, you cannot file a claim for your pain and suffering.

However, in the case of an accident in which the other driver was drunk, this limitation does not apply. You can file a personal injury lawsuit for any degree of injury suffered in a drunk driving accident.

Who Pays Damages for Injuries Caused by a Drunk Driver?

There are at least four possible sources of financial recovery in a drunk driving accident:

·         The first is the other driver's insurance policy.

·         Your own insurance policy, if the other driver was uninsured or underinsured and you carry uninsured and underinsured motorist coverage.

·         If the driver was drinking at a bar or a private party, you may be able to bring a claim against the bar or the person who served the alcohol under dram shop law.

·         The drunk driver's own personal assets. You can seek punitive damages against the drunk driver's estate.

I work hard to ensure my clients' bills are covered and that they receive the medical and rehabilitative care they need to make a full recovery from injuries suffered in a drunk driving accident.
